Dismissal of Doctors’ Appeals in a Medical Negligence Case – Confirmation of €1,300,000 Compensation in Favour of the Respondent
A final judgment was delivered in favour of the claimant, whom we represented, in a serious medical negligence case concerning negligent acts and omissions during the post-operative monitoring of a patient. The Court dismissed the appeals filed by the defendant doctors and fully upheld the first-instance judgment, by which liability had been established and compensation awarded in favour of the claimant.
The case concerned a series of surgical procedures and the subsequent management of an epidural catheter. During the critical period following the surgeries, the claimant exhibited symptoms which were not adequately assessed or investigated by the defendant doctors. The Court found that the defendant doctors failed to carry out appropriate clinical evaluation, to perform the necessary diagnostic examinations, and to take timely therapeutic measures.
As a result of these omissions, an infection developed in the epidural space, which was neither diagnosed nor treated in a timely manner. The infection progressed further and led to the formation of an epidural abscess, which in turn caused damage to the spinal cord (transverse myelitis). This resulted in paraplegia of the Respondent, with particularly severe consequences for her mobility, functionality and overall quality of life, ultimately confining her permanently to a wheelchair.
The doctors were found liable for the infection that developed in the epidural space as a consequence of the placement of the epidural catheter and its prolonged retention, without the exercise of appropriate medical care and attention by the said doctors.
The first-instance Court, having assessed extensive medical evidence and expert testimony from specialist doctors of various disciplines, concluded that there was a clear causal link between the negligent acts and omissions of the defendants and the injury suffered by the claimant. Particular weight was given to the evidence of independent medical experts, who demonstrated that, had the appropriate measures been taken in a timely manner, the extent of the damage could have been avoided or, at the very least, substantially limited.
In the context of the appeals, the defendant doctors challenged, inter alia, the findings of the first-instance Court regarding the existence of negligence and the causal link. The Court of Appeal, having examined the evidential material as a whole, held that the findings of the first-instance judgment were fully and properly reasoned, based on reliable and consistent medical evidence, and that there was no basis for interfering with the conclusions of the trial court.
This judgment constitutes an important judicial affirmation of the heightened duties of care borne by medical practitioners, particularly at the stage of post-operative monitoring and the timely adoption of appropriate diagnostic and therapeutic measures. At the same time, it strengthens patient protection and the possibility of effective redress in cases of serious medical negligence.
