Issuance of an Interim Prohibitory Injunction by the Larnaca District Court

By an order dated 9 August 2024, the Larnaca District Court, in the context of Action No. 451/2024, granted an ex parte application filed by the claimant company and issued an interim prohibitory injunction aimed at preserving the subject matter of the dispute until the determination of the proceedings.
Having examined the affidavit filed on behalf of the claimant and following the provision of a €50,000 security for potential damages and costs, the Court held that the requirements for the granting of interim relief were satisfied.
By virtue of the order, the defendants and any persons acting on their behalf were restrained from taking any action that could result in a direct or indirect change to:
- the shareholding structure,
- the management and board of directors, or
- the administration of specific companies,
as well as from proceeding with any transfer or alteration relating to the ownership or possession of the disputed immovable property.
The injunction shall remain in force until the final determination of the application or until further order of the Court. At the same time, a return date was set for the respondents to appear and show cause why the injunction should not continue in force.
This decision underscores the importance of interim prohibitory injunctions as a mechanism of immediate judicial protection, particularly in disputes involving corporate matters and immovable property, where any alteration of the status quo may result in irreparable harm prior to the final adjudication of the case.
